Public Comment Period for Local Bankruptcy Rules and Forms

In February 2017, the Court solicited input from the Committee on Local Rules, who further solicited comments from chapter 13 practitioners, regarding whether the District of New Hampshire should adopt a local chapter 13 form plan, as permitted by proposed Federal Rule of Bankruptcy Procured 3015(c) (taking effect on December 1, 2017), instead of the national chapter 13 plan being adopted effective December 1, 2017 (Official Form 113 – Chapter 13 Plan). The Committee has recommended that the Court not use the national chapter 13 plan but instead continue to use Local Bankruptcy Form 3015-1A, making modifications as necessary to comply with proposed Federal Rule of Bankruptcy Procedure 3015.1 (taking effect on December 1, 2017). Having considered the Committee’s comments and recommendation, as well as their suggested changes to LBF 3015-1A, as well as the requirements of proposed Rule 3015.1, the Court has made further revisions to LBF 3015-1A.

In compliance with proposed Rule 3015.1(a), the Court hereby provides this notice and seeks public comment on revised LBF 3015-1A, which the Court intends to adopt as its local plan effective December 1, 2017.

In addition, the Court intends to amend Local Bankruptcy Rule 3015-1(b) and Local Bankruptcy Form 3015-1B to conform to amendments being made to Federal Rule of Bankruptcy Procedure 3015(d). The Court has also drafted and seeks comments on proposed Local Bankruptcy Rule 3001-2.

A 30-day public comment period will commence on September 11, 2017 and end on October 11, 2017. The revisions are available for review on the Court’s website at www.nhb.uscourts.gov. In addition, a paper copy is available for review at the Clerk’s Office.

Comments with respect to these LBRs and LBFs must be made in writing by sending an e-mail to LocalRules@nhb.uscourts.gov, or you may hand-deliver or mail your comments to the Clerk’s Office at the address below.
